Welcome to SPYCE (“we,” “our,” or “us”). Our services include an online platform where customers can order food from participating restaurants and stores, which we then deliver to your specified location (collectively, the "Services").
By using our Services, you are agreeing to these Terms of Use, as well as our Privacy Policy. If you do not agree with these Terms of Use or our Privacy Policy, please do not use our Services.
To use our Services, you must be at least 18 years old, or the age of legal majority in your jurisdiction if different. You must also have the legal capacity to enter into these Terms and use our Services in compliance with all applicable laws and regulations.
To use our Services, you may need to register for an account. You are responsible for providing accurate, current, and complete information during the registration process. You are also responsible for maintaining the confidentiality of your account password and for all activities that occur under your account.
When you place an order through our Services, you authorize us to act on your behalf to purchase and deliver products from participating restaurants and grocery stores. All orders are subject to acceptance by the respective restaurant or store and availability of items. Delivery times are estimates only and we are not liable for any delays.
You agree to pay all fees and charges incurred in connection with your orders. All prices are inclusive of applicable taxes. We reserve the right to adjust pricing at any time. If your payment method fails, we reserve the right to collect fees owed using other collection mechanisms.
Orders can be cancelled prior to being accepted by the restaurant or grocery store. Once an order has been accepted, it cannot be cancelled. In the event of a problem with your order, please contact our customer service immediately. Refunds will be handled on a case-by-case basis.
All intellectual property rights in our Services, including our website and app, are owned by SPYCE or our licensors. You may not copy, distribute, publicly perform, publicly display, or create derivative works of our Services without our express permission.
In the event of a dispute arising from these Terms, we encourage you to contact us to seek a resolution. Any unresolved disputes shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association.
We may modify these Terms at any time. If we make changes, we will notify you by revising the date at the top of the policy and, in some cases, provide you with additional notice. Your continued use of our Services following the posting of revised Terms means that you accept and agree to the changes.

These Terms are governed by and construed in accordance with the laws of the state of British Columbia, without giving effect to any principles of conflicts of laws.
